Terms & Conditions

1. What Roam is, and what Roam is not

Roam is an introduction service. Roam introduces a company that wants an item moved (the Sender) to a traveller who is already making that journey (the Steward).

Roam is not a carrier, a courier, a freight forwarder, a logistics operator, a broker, or an agent of either party. Roam does not transport anything. Roam does not collect, hold, store, handle, open, pack, inspect, test, weigh or take custody of any item at any point.

Roam is not a party to the transport arrangement. Where a Sender and a Steward agree that the Steward will carry an item, that agreement is between the two of them. Roam's role ends with the introduction, the exchange of information both parties have chosen to share, and the administration of payment described in section 8.

2. The arrangement is between the Sender and the Steward

The Sender and the Steward each decide, for themselves, whether to proceed.

  • The Sender decides whether to accept the Steward that Roam proposes. The Steward is named before the Sender commits to anything. A Sender who is not satisfied is under no obligation to proceed and may decline without giving a reason.
  • The Steward decides whether to accept the item. Before accepting it, the Steward must inspect the item, its contents and its condition, and keep a record of what they saw (for example a photograph or a short note). The Steward may ask any question of the Sender and may decline at any stage, for any reason or for none, with nothing owed and nothing to explain.

By proceeding, each party accepts that they are contracting with the other and not with Roam, and that the risks of the arrangement lie between them.

3. Our conditions are guidance, not a check we perform

Roam publishes conditions describing what is suitable to send, and asks questions on its forms about the item, the route and the dates.

Those conditions exist to help you. They are a starting point so that neither party has to work out from scratch what is sensible to move by this method, and so that obviously unsuitable requests are recognised early. They are guidance and nothing more.

They are not:

  • a warranty by Roam that any item meets them;
  • a statement that Roam has checked, verified or confirmed anything;
  • an undertaking by Roam to enforce them, to police them, or to detect a breach of them;
  • a substitute for either party's own judgement, enquiries or professional advice.

Roam does not verify what a Sender declares and does not enforce compliance with these conditions. Roam relies entirely on what each party states. Each party must satisfy itself, before proceeding, that the arrangement is lawful, safe and suitable for its own purposes, and must take whatever further steps that requires. Both parties are expected to be careful and to be well informed, and to act accordingly.

4. What the Sender is responsible for

The Sender warrants, on each request, that:

  • the item is lawful to send, to carry and to receive, in every country the journey passes through;
  • the description the Sender gives is complete and accurate, and does not omit anything that would affect a reasonable person's decision to carry it;
  • the item is not, and does not contain, anything excluded under section 5;
  • the Sender is entitled to send the item and holds any consent, licence or permission required;
  • the item is packaged appropriately for the journey;
  • sending the item does not breach the terms of any transport operator whose service the Steward uses.

The Sender remains responsible for the item and for the consequences of sending it. Roam gives no warranty about the Steward, their conduct, their reliability, their identity, their punctuality, or the outcome of any journey.

5. What must not be sent

Illegal goods; weapons; dangerous, hazardous, explosive, flammable, pressurised or radioactive goods; drugs; live animals; perishable or temperature-controlled goods; cash, and bearer instruments; anything requiring a licence the Sender does not hold; and anything the Sender is not entitled to ship.

This list is guidance and is not exhaustive. It does not limit the Sender's obligations under section 4, and Roam does not check whether it has been observed.

6. What the Steward is responsible for

The Steward decides whether to carry an item and does so voluntarily. The Steward is responsible for inspecting and recording the contents and condition of any item before accepting it, for satisfying themselves that it is within these conditions, and for keeping that record. If a dispute arises, Roam may ask the Steward to provide it; the burden of showing what was accepted lies with the Steward. The Steward is also responsible for their own decision, their own journey, their own compliance with the terms of any transport operator they travel with, and their own conduct while carrying an item.

Roam does not instruct, direct, employ, engage or supervise any Steward. No Steward is an employee, worker, agent, subcontractor or representative of Roam.

7. Liability

Roam accepts no liability arising out of or in connection with an arrangement introduced through it. To the fullest extent permitted by law, and without limiting the generality of that statement, Roam is not liable for:

  • loss of, theft of, damage to, delay to, seizure of, or failure to deliver any item;
  • any act or omission of a Sender or a Steward;
  • any injury, loss or damage suffered by a Sender, a Steward, or any other person;
  • any loss suffered by a third party arising from an item or a journey;
  • any fine, penalty, charge, detention or enforcement action imposed on either party;
  • any indirect or consequential loss, loss of profit, loss of contract, loss of business, or loss of reputation.

As between the Sender and the Steward, liability lies with them. Each of them is responsible to the other, and to any third party, for their own acts, omissions and breaches. Each of them agrees to hold Roam harmless in respect of any claim brought against Roam arising from that party's own breach of these terms.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which applicable law does not permit to be excluded. Where any provision of this section is held to be unenforceable, the remaining provisions continue to apply.

8. Payment

The Sender pays Roam before dispatch, using the payment link provided with the proposal. Roam pays the Steward after the item has been handed over. There is no platform or booking fee during the pilot: the agreed shipment price is the total price.

Roam administers that payment as a convenience to both parties. Doing so does not make Roam a party to the transport arrangement and does not give Roam any responsibility for the item or for the conduct of either party.

9. Insurance

Roam provides no insurance and arranges none. Any cover for a particular shipment must be confirmed separately in writing before dispatch. Where no such confirmation exists, no cover should be assumed to exist. Each party is responsible for arranging its own insurance and should satisfy itself that any policy it relies on responds to this method of transport.

10. Nothing is booked until we confirm it

A request is an enquiry. It becomes an arrangement only when Roam replies confirming the price and the dispatch date, and both parties proceed. Roam may decline any request, at its discretion, without giving a reason.

11. Pricing

The Sender states a maximum. The Steward states a minimum. Roam proposes a price between the two, confirms the Sender's own figure, counters within approximately 10% of it, or declines. Neither party is shown the other's figure.

12. Data

Roam's handling of personal data is described in the privacy notice.

13. Changes, and getting in touch

Roam may update these terms. The version in force for any arrangement is the version published when the request was made. These terms are under review by a qualified transport lawyer and a reviewed version will replace this one.
